All employers in South Africa must be registered with the Compensation Fund.
This applies to every employer which has one employee or more.
Workers compensation is statutory insurance that benefits both the injured employee and his or her employer. It gives employees guaranteed benefits and it protects employers from common-law claims for damages.
In order for your workers to be covered against occupational diseases, injuries and death, you must register with the Compensation Fund.
The fund covers an employee who is:
- permanently employed
- a domestic worker in a boarding house
- an apprentice or trainee farm worker and
- a worker paid by a labour agency.
The Compensation for Occupational Injuries and Diseases Act 130 of 1993 intends:
- to provide for compensation for disablement caused by occupational injuries or diseases sustained or contracted by employees in the course of their employment, or for death resulting from such injuries or diseases; and
- to provide for matters connected therewith.
